Terms of Service for Trax

1. Acceptance of Terms

By downloading, installing, accessing, or using the Trax mobile application ("App" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service.

These Terms constitute a legally binding agreement between you and Corner Office Software LLC, a Delaware limited liability company ("Company," "we," "us," or "our").

2. Age Requirements and Eligibility

2.1 Minimum Age

You must be at least 13 years old to use our Service. If you are under 13, you are not permitted to use the App and must not provide any personal information to us.

2.2 Parental Consent

If you are between 13 and 18 years old, you represent that you have your parent's or legal guardian's permission to use the Service and that they have agreed to these Terms on your behalf.

2.3 Capacity to Contract

You represent that you have the legal capacity to enter into this agreement and that you are not prohibited from using the Service under applicable law.

3. License to Use the Service

3.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device for your personal, non-commercial use.

3.2 License Restrictions

You may not:

• Copy, modify, distribute, sell, or lease any part of our Service
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels
• Use the Service for any commercial purpose without our written consent
• Attempt to gain unauthorized access to our systems or networks

• Create derivative works based on the Service

4. User Guidelines and Acceptable Use

4.1 Prohibited Activities

You agree not to:

• Post false, misleading, or fraudulent wildlife reports
• Harass, threaten, or intimidate other users
• Post content that is illegal, harmful, or violates others' rights
• Spam or send unsolicited communications
• Impersonate another person or entity
• Interfere with the proper functioning of the Service
• Use the Service to violate any applicable laws or regulations

4.2 STRICTLY PROHIBITED CONTENT

ZERO TOLERANCE POLICY FOR INAPPROPRIATE CONTENT

The following content is strictly prohibited and will result in immediate account termination:

4.2.1 Explicit Content

• Pornographic, sexually explicit, or sexually suggestive content
• Nudity or partial nudity
• Sexual acts or sexualized content
• Adult content of any kind

4.2.2 Violent or Harmful Content

• Graphic violence, gore, or disturbing imagery
• Content depicting or promoting violence against people or animals
• Self-harm or suicide-related content
• Content that could cause physical or emotional harm

4.2.3 Hate Speech and Discrimination

• Content that promotes hatred, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
• Slurs, derogatory language, or offensive stereotypes
• Content that incites violence or hatred

4.2.4 Harassment and Bullying

• Personal attacks, threats, or intimidation
• Cyberbullying or online harassment
• Stalking or unwanted contact
• Content designed to embarrass, humiliate, or shame others

4.2.5 Illegal Content

• Content that violates any local, state, federal, or international law
• Content promoting illegal activities
• Copyright infringement or intellectual property violations
• Fraudulent or deceptive content

4.2.6 Inappropriate Wildlife Content

• Content that shows harm to wildlife (except for legitimate safety reporting)
• Content promoting illegal hunting, poaching, or animal cruelty
• Misleading or false wildlife information that could endanger others
• Content that violates wildlife protection laws

4.2.7 Spam and Commercial Content

• Unauthorized advertising or promotional content
• Spam, repetitive, or irrelevant content
• Content designed to manipulate or deceive users
• Pyramid schemes or other fraudulent business practices

4.3 Content Enforcement

• Immediate Action: Any violation of our content policies will result in immediate content removal and account suspension or termination
• No Warnings: We maintain a zero-tolerance policy for inappropriate content
• Reporting: Users are encouraged to report inappropriate content immediately
• Review Process: All reported content will be reviewed promptly
• Appeals: Limited appeal process available for account terminations

4.4 Wildlife Reporting Guidelines

When creating wildlife reports, you must:

• Provide accurate information about animal sightings
• Use appropriate and respectful language
• Not post false or misleading reports
• Respect wildlife and their habitats
• Follow local laws and regulations regarding wildlife
• NEVER post inappropriate content in wildlife reports

4.5 Content Standards

All content you post must be:

• Accurate and truthful
• Respectful and appropriate
• Your own original content or properly attributed
• Compliant with applicable laws
• Free from any inappropriate content as defined above

5. Account Creation and Security

5.1 Account Registration

To use certain features of the Service, you may need to create an account. You agree to:

• Keep your account information up to date
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

5.2 Account Security

14.2 Wildlife Safety Disclaimer

THE SERVICE IS FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT GUARANTEE YOUR SAFETY. WILDLIFE BEHAVIOR IS UNPREDICTABLE. ALWAYS EXERCISE CAUTION AND FOLLOW LOCAL WILDLIFE SAFETY GUIDELINES.

14.3 Location Data Disclaimer

LOCATION DATA MAY NOT BE ACCURATE OR CURRENT. DO NOT RELY SOLELY ON THE SERVICE FOR NAVIGATION OR SAFETY DECISIONS.

14.4 User Content Disclaimer

WE DO NOT ENDORSE, SUPPORT, OR GUARANTEE THE ACCURACY, RELIABILITY, OR APPROPRIATENESS OF USER CONTENT. WE ARE NOT RESPONSIBLE FOR ANY USER CONTENT OR ITS CONSEQUENCES.

14.5 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

14.6 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

15. Indemnification

You agree to indemnify, defend, and hold harmless Corner Office Software LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content
• Any inappropriate content you post or share

16. Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

YOU AGREE THAT ANY ARBITRATION OR LEGAL PROCEEDING WILL BE LIMITED TO THE DISPUTE BETWEEN YOU AND US INDIVIDUALLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

16.5 Exceptions to Arbitration

The following disputes are not subject to arbitration:

• Claims for injunctive or equitable relief
• Small claims court actions
• Intellectual property disputes
• Claims related to or arising from allegations of theft, piracy, or unauthorized use
